<p>Do ensure solicitor does not make a claim from Legal Aid Agency for the Legal Help costs, too.  It&#8217;s either/or, not both, even though there might only be a small element of the Legal Help that is, in reality, deemed of an IP nature.</p>

The only problem I find is that the oral hearing tends to be a waste of time, as it&#8217;s almost impossible to convince a Judge to change their mind. It should be more akin to an appeal process before a more senior Judge.</p>

<p>One thing does strike me. Was a 26(1) order necessary? Do they need to do all the means/ability to pay stuff as costs prot does not apply or in your view is the Section 26(1) LASPO protection a more general ability to pay protection provision distinct from the stricter Cost Regs protection.</p>

									<content:encoded><![CDATA[<p>Sorry Rob &#8211; can&#8217;t help with most of this but the backstop you mention was actually to get an order against the LAA rather than the LC (I say &#8216;was&#8217; as I&#8217;m not sure if it&#8217;s still there or not).  The application had to be made within 3 months.</p>
<p>Hope you get a response from someone who knows a lot more than I do as I&#8217;d be interested to know too!</p>
