Provisional assessment aid

Many members have become increasingly aware of the issues experienced around provisional assessment. Other branches of the professional are equally aware of these, to the extent that we have now been approached by the Forum of Insurance Lawyers to support its representations to the Civil Procedure Rule Committee and the Association of District Judges to set out what is going wrong, ideas to rectify them and how we feel we can assist.

With that in mind, please take a few minutes to add a post detailing your own experiences to the discussion which is now up and running on the website forum. These will then be cross-referenced with those identified in the draft prepared by FOIL and any additional points added.

It is anticipated that the draft will be signed off for sending on 23 January.

Costs specialists find synergy

Costs Lawyer Janet Lavelle and costs consultant Clare Parnell have joined forces to form a new Cardiff-based firm, Synergy Costs. Ms Lavelle was previously a director of, and Ms Parnell a consultant at, John M Hayes. The pair are offering a full drafting service and have particular expertise in high-value serious and catastrophic claims in both personal injury and clinical negligence matters. Ms Lavelle is a contributing author to Butterworths Personal Injury Litigation Service and a co-opted member of the council of Cardiff and District Law Society.

New costs silk

Well-known costs counsel Ben Williams – a member of 4 New Square – is one of the 93 new QCs announced this week. He has been involved in many of the landmark cases since the start of the costs war, ranging from Sarwar v Allam and Hollins v Russell to C v W and Tankard. His insurance work has included the litigation arising from collapsed claims management schemes (such as TAG and Imperial Consolidated), as well as the long-running credit hire litigation, including the Bent case.
