Guidance for Costs Lawyers employed by solicitors’ firms

The Costs Lawyer Standards Board (CLSB) has published a short guidance note for Costs Lawyers who work in firms that are regulated by the Solicitors Regulation Authority (SRA) following what it said was “an increasing number of enquiries” about the overlap between the SRA’s new code of conduct for firms – which catches the activities of Costs Lawyers as employees – and its own code of conduct, which applies to Costs Lawyers as individual practitioners.

It explains that, in the unlikely event of a conflict between the two, the Legal Services Act 2007 provides that the rules of the regulator authorising the firm prevail over the rules of the regulator authorising the person.


Costs judge’s technology fail

The Senior Costs Judge has demonstrated the perils of online hearings in his explanation for why his judgment in Iwuanyawu v Ratcliffes Solicitors [2020] EWHC B25 (Costs) – the detail of which we report on separately this week – was reserved, rather than ex tempore judgment as expected.

Master Gordon-Saker explained: “The hearing was held remotely by Skype and proceeded fairly smoothly until, towards the end, the recording stopped and would not restart. That turned out to be because my computer’s hard drive had filled to capacity and would accept no more Skype recordings, for which I apologise.

“Accordingly, I recorded the remainder of the hearing on my mobile telephone and, as by then my computer was struggling to open any documents, I reserved judgment.”


DWF boosts costs team

DWF Costs – the specialist arm of listed law firm DWF – has swooped on three partners from Horwich Farrelly. The Manchester firm’s former head of costs Nicola Critchley – who also sits on the Civil Justice Council and Civil Procedure Rule Committee – joins this month, followed by Anna Poynton and Rob Bennett in September.
